This policy applies to information collected when you engage with our services, including when you submit your information through our LinkedIn lead generation forms, website, or advertisements. If you become a client, a separate Client Services Agreement will govern how we handle your health and performance data.

1. What Information We Collect

When you submit our LinkedIn lead form, we collect:

  • Name
  • Email address
  • Phone number
  • LinkedIn profile URL

We may also collect information about how you interact with our website and advertisements through cookies and tracking technologies (see Section 8 for details).

2. How We Use Your Information

We use your contact information to:

  • Contact you via email, phone calls (which may use automated dialing technology), and SMS text messages about our executive health optimization services
  • Send marketing communications about our programs, resources, and offerings
  • Schedule consultations if you express interest in our services
  • Provide customer service and respond to your inquiries
  • Improve our services and advertising performance by understanding how prospects engage with our business

SMS Text Message Consent

By submitting your information and checking the consent box, you expressly consent to receive automated marketing text messages (e.g., promotions, appointment reminders, and service updates) from Evans Performance at the phone number you provide.

  • Consent is not required as a condition of purchasing any goods or services.
  • Message frequency varies based on your engagement and our marketing activities.
  • Message and data rates may apply. Check with your mobile carrier for details.
  • Text STOP to opt out at any time. Text HELP for assistance.
  • Carriers are not liable for delayed or undelivered messages.

By consenting, you acknowledge that you are authorized to provide this phone number and that you are the account holder or have the account holder's permission to receive texts at this number.

Client SMS Communications

If you become a client of Evans Performance LTD, you will receive automated text messages as part of your coaching program. By signing your coaching agreement (via DocuSign), you consent to receive:

  • Weekly health check-in reminders with links to submit your progress
  • 90-day scorecard notifications with links to review your results
  • Program-related updates and reminders

Message frequency varies based on your coaching program. Message and data rates may apply.

Consent is not required as a condition of purchasing coaching services.

3. Who Has Access to Your Information

We do not sell your personal data. We may share your information with trusted third-party service providers who help us deliver our services, including:

  • Customer relationship management (CRM) platforms
  • Email marketing and communication tools
  • Appointment scheduling services
  • Analytics and advertising platforms (including Google and LinkedIn)
  • SMS/text messaging services

Important: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

These service providers are contractually required to protect your information and use it only to provide services to us.

4. How Long We Keep Your Information

We retain your contact information for up to 7 years for business record-keeping, marketing, and legal compliance purposes, unless you request deletion or opt out of communications.

If you request deletion of your information, we will delete it within 30 days, except where retention is required by law.

5. Your Rights and Choices

Unsubscribe from Emails

Every marketing email includes an unsubscribe link. Click it to stop receiving marketing emails.

Opt Out of SMS Messages

Reply "STOP" to any text message to opt out of SMS communications.

Opt Out of Phone Calls

To stop receiving marketing calls, email support@evansperformancesystems.com or inform us during any call. We will honor your request within 30 days.

Request Deletion

To request deletion of your information from our systems, email us at support@evansperformancesystems.com with "Delete My Information" in the subject line.

Access Your Information

You can request a copy of the information we have about you by emailing support@evansperformancesystems.com.

6. Data Security

We implement reasonable technical and organizational measures to protect your information from unauthorized access, disclosure, alteration, or destruction. However, no internet transmission is completely secure.

7. Geographic Scope

Our services are currently marketed to individuals in the United States. By submitting your information, you consent to the processing and storage of your data in the United States.

8. Cookies and Tracking

We use cookies and tracking technologies (including LinkedIn Insight Tag and Google Analytics) on our website to track visitor behavior and optimize our advertising. You can control cookies through your browser settings.

We may also retarget you with advertising on LinkedIn, Google, and other platforms. You can opt out at www.aboutads.info/choices or www.networkadvertising.org/choices.

9. California Privacy Rights (CCPA/CPRA)
